Statement of Use

A Statement of Use is a legal document required to prove that a trademark is actively being used in commerce. After receiving a Notice of Allowance, which indicates that your trademark application has been approved, this document must be filed with the Intellectual Property Office (IPO). It includes details such as the first use date, the goods or services associated with the trademark, and examples of how the mark is used in commerce.

For applications based on intent-to-use, filing a Statement of Use is necessary to demonstrate that the mark is now in use. This statement must be submitted within six months of receiving the Notice of Allowance. If you are unable to file within this timeframe, you must apply for a six-month extension. Let us assist you in navigating this process and ensure you avoid critical mistakes in demonstrating your trademark’s commercial use.
